These are the terms for using Tipscale. They are meant to be read, so they are short.

The licence

Tipscale is licensed to you, not sold. You may install and use it on the Apple devices you own or control, for your own personal use, under the terms below and under Apple's Licensed Application End User Licence Agreement, which applies to every app bought from the App Store.

Where these terms are silent, Apple's standard agreement applies. You can read it at apple.com/legal/internet-services/itunes/dev/stdeula.

You may not copy, sell, rent, sub-license, reverse-engineer or redistribute the app, except where the law gives you that right regardless of what this says.

The free trial

Tipscale gives you seven days with everything unlocked, with no payment and no commitment. Nothing is charged during the trial and nothing starts automatically when it ends.

When the seven days are up, Tipscale keeps counting your steps and your rides and keeps showing you Today. The Week tab, Trends, the badges, notifications, the widgets, the watch app and the app icons need Tipscale Pro.

Nothing you have recorded is taken away or held to ransom. Your history stays on your device, and it is all there again the moment you unlock Pro.

Subscriptions and the one-off purchase

Tipscale Pro is sold three ways: monthly, annual and lifetime.

• Monthly and annual renew automatically until you cancel. Your Apple Account is charged at the price shown before you buy, and again at the start of each new period.
• Cancel in the App Store, under your account's subscriptions, at least 24 hours before the period ends. Cancelling stops the next charge; it does not refund the period you are in.
• Lifetime is a single payment with nothing to renew and nothing to cancel.
• Prices are set per region by the App Store and may change. A change to the price of a subscription you already hold is put to you by Apple before it takes effect.

Payment, billing and refunds are Apple's, not ours. We never see your card, and we cannot issue a refund. Ask Apple, through Report a Problem or through Apple Support.

What Tipscale is not

Tipscale is a counting tool, and that is all. It is not a medical device, it is not diagnostic, and it is not advice.

It makes no promise about your health. It does not claim that using it will make you fitter, lighter, healthier or happier, or that any number it shows is good or bad for you. If you are making decisions about exercise and you have a reason to be careful, ask someone qualified rather than an app.

What Tipscale cannot promise about its numbers

Ride detection reads the motion history iOS keeps. It is good, and it is not perfect: a short trip can be missed, a bus can read as a car, a train can read as neither. Steps come from Apple Health or from your iPhone's pedometer and are as accurate as those are.

Tipscale is provided as it is, with no warranty, express or implied, beyond what the law requires and beyond what Apple's own agreement gives you. We do not promise it will be uninterrupted, error-free, or right about every journey.

To the extent the law allows, we are not liable for indirect or consequential loss arising from using the app. Nothing here limits liability that cannot lawfully be limited, and nothing here affects your statutory rights as a consumer.

Your data

Tipscale keeps your movement on your device and sends none of it anywhere. What it does send, once a day and anonymously, is listed in full on the Privacy page. Read that page as part of these terms.

Changes

We may change these terms when the app changes. The date at the top says when they were last changed, and a version of the app that needs different terms will ship with them. Continuing to use Tipscale after a change means you accept it; if you do not, stop using the app and cancel any subscription.

Governing law

These terms are governed by the law of the place where the developer is established, and by any consumer protection law of your own country that applies to you whatever this document says. If a court finds one part of these terms unenforceable, the rest stands.
